Start with the hard wall: a foreigner cannot own land in their own name in Thailand. The mainstream legal route for a house or villa is to lease the land. And here Thai law is blunt — the Civil and Commercial Code (Section 540) caps a registered lease at 30 years. You can renew, but renewal is a fresh agreement, not a guarantee.
For years, developers and agents sold "30+30+30 = 90 years" as if it were near-ownership: sign now, and the contract automatically rolls over twice. The problem is that a written promise to renew beyond 30 years tries to defeat the very cap in Section 540 — so courts have long treated those auto-renewal clauses as unenforceable against later owners.

On 18 March 2025, the Supreme Court issued ruling 4655/2566. The court held that a promise to automatically extend a lease for two further 30-year terms (the classic 30+30+30) is void and cannot be enforced, because it is an attempt to circumvent the 30-year ceiling in Section 540. Only the first 30 years are legally guaranteed.
In plain terms: when your first 30 years are up, you have no automatic legal right to the next 30. Any renewal must be negotiated as a brand-new contract — and the landowner (or whoever owns the land by then) can say no, raise the price, or sell to someone else.
If a project or agent is still selling you "90 years guaranteed", treat it as a red flag. The 90-year guarantee does not survive this ruling. You are buying roughly 30 secure years plus a hope of renewal — price the property accordingly.

A well-drafted villa structure often pairs a registered land lease + superficies over the house + a lifetime usufruct. That gives you strong, lawful use for your lifetime. What it does not give you is permanent, freely inheritable ownership of the land itself. Know the difference before you pay villa money.

This is where land-lease villas hurt families. A standard 30-year lease and a personal usufruct end on death — they generally do not pass to your spouse or children. A superficies over the house can be inherited, but your heirs then own a house standing on land they have no right to.
And §1416 of the Civil and Commercial Code is the sting in the tail: when the superficies ends, the foreigner may have to remove the building, or the landowner has the option — not the obligation — to buy it. If the landowner declines to buy, your family is left holding a structure they can't keep on land they can't own. That is a very weak position to inherit.
If passing the home to a Thai spouse or children matters to you, a land-lease villa needs careful, lawyer-drafted structuring — or you may be buying a 30-year right that quietly dies with you.

None of this means "never buy a villa". Plenty of foreigners happily own land-lease homes in Chiang Mai. It means buying honestly: a leased villa is best understood as a home to live in for ~30 years (or your lifetime), not a permanent freehold asset. To do it safely: choose a reputable developer, structure the lease + superficies + usufruct properly with a licensed lawyer, consider a Thai spouse's ownership where appropriate, and price in the renewal risk.
Want a permanent, inheritable asset → condo in the freehold quota. Want the lifestyle of a house/pool villa → a properly structured land lease, understood as ~30-year right, not 90-year ownership.
